Digital Web Future welcomes you to know more about our terms and conditions. We believe in maintaining complete transparency, and to keep you well informed, all our terms and conditions are outlined below.

Web Hosting Agreement and Terms of Service:

Digital Web Future – standard policies, terms, and conditions. The following policies and service terms are mandatory for signing up and using our hosting services. Kindly ensure that you read and agree to them before proceeding. For any queries or clarifications, feel free to reach out to us. Digital Web Future reserves the right to modify these terms and usage policies at any time. Serving a wide community of clients, the security of every individual client has always been our top priority.

Change in Packages and Pricing:

Digital Web Future reserves the right to modify service offerings and prices at any time. All price and service-related information on our site may change without prior notice. Price revisions are at our sole discretion. For all new sign-ups, the revised prices will be applicable, whereas existing orders placed before the price revision will remain unchanged.

Any update in pricing or services published on our site may occur without prior intimation. Price increases, if any, will be applied to future deals only, while existing clients with earlier deals will retain the original pricing. Account setup occurs only after receipt and confirmation of payment, post verification procedures. It is your responsibility to provide accurate details for verification; delays may occur otherwise.

Late / Non-Payment:

A Rs. 10,000 administrative fee applies to the reactivation of canceled accounts.
If your account is overdue by 15 days, all technical support will be discontinued.
If overdue by 30 days, your website and services will be suspended.
If overdue by 45 days, your data and website will be permanently deleted.
In the event of a chargeback or transaction reversal, the account will be terminated immediately, and all associated data, emails, and websites deleted.
We make every effort to contact clients, but it is your responsibility to keep your contact, billing, and address details current

Regular Updates of Details:

We use the most recently available contact information. If you fail to receive our communications due to outdated details, we are not liable. Clients are solely responsible for keeping their contact information up to date. We will not be responsible for missed notifications or actions resulting from such missed communication.

Spam Policy:

We maintain a strict zero-tolerance policy towards Unsolicited Commercial Email (UCE) or SPAM across our network. No client or reseller may use our services to distribute UCE. Violating this may lead to service termination without notice and financial penalties. Upon detecting a potential violation, we will initiate an investigation. During this time, access may be restricted. Confirmed violations may result in immediate account termination and civil proceedings to recover investigative costs. Law enforcement may be informed in cases of criminal activity.

Penalties include an Rs. 10,000 administrative fee for the first violation and account termination. Repeat violations incur Rs. 15,000 and permanent account termination. Our resellers must enforce similar policies among their clients. Mass mailing is not allowed from shared servers. Clients are advised to use third-party services or dedicated servers for bulk emails.

Prohibited Use of Services and Products:
All services must be used in accordance with company policy and purposes. If uncertain about the acceptable use, please consult us directly. The following uses are strictly prohibited:

General:

Illegal activities: Transmitting or storing content that violates any laws is forbidden.

Threats and harm: Using our services to promote violence, harm, or illegal content is prohibited.

Intellectual property violations: Publishing or transmitting copyrighted material without proper authorization is strictly forbidden.

Unauthorized data collection: Gathering personal information without consent is not allowed.

System and Network Abuse:

Violating system or network security may result in criminal or civil actions. We will prosecute cases involving unauthorized access, denial-of-service attacks, and malware distribution.
Activities such as port scanning, spoofing, unauthorized logins, and use of scripts to manipulate server resources are forbidden.
Attempts to interfere with server operations, usage tracking, or bandwidth monitoring are prohibited.

Prohibited Scripts and Programs:

Only scripts that consume minimal server resources are allowed. Scripts using excessive RAM or CPU will result in account suspension. Sites using more than 10% of resources will be paused until resolved. External or third-party scripts may not be used.

Resource-heavy scripts like Java/Perl chat rooms and banned scripts including:

UltimateBBS, Ikonboard, FormMail, CgiEmail

IRC bots/servers, Proxy servers

Daemon processes, Game servers

The Anonymizer, Security Auditing Tools

Spamming tools, Shell scripts, Telnet utilities
…are strictly prohibited.

Loss of Backup and Data:

Using our services is entirely at your own risk. Digital Web Future is not responsible for any data or files on your account. Clients are responsible for data transfer and must maintain proper backups. Weekly backups may be taken for server restoration only.

Mailing List Hosting:

We do not support mailing list hosting. Any mailing lists will be removed without notice. Adult content and related marketing are also banned. Any site containing or linking to sexual or illegal content will be taken down. Promotion of unlawful activity or harming other servers is not permitted.

Ownership Details – What You Own and What You Don’t:

Web Server: Offered complimentary with some packages (as specified). Clients do not own it.

CMS (Content Management System): Not owned by clients. It’s proprietary software created and managed by Digital Web Future.

Database Software: Clients don’t own database software like MySQL. However, data/content input by the client is owned by the client.

Source Code (Custom Code): Not owned by clients. This includes logic connectors and backend processes.

HTML/CSS/JavaScript: Clients own these upon project completion and final payment.

Visual Design: Clients own the visual aspects of the website (colors, images, layout, etc.) upon full payment.

Text Content: Clients own content they or their employees authored.

Photography: Clients own images only if they or their employees captured them.

Domain Name: Clients do not legally own domain names. A contract with the registrar gives them exclusive usage rights, not legal ownership.

Legal Ownership Summary:

Clients never legally own the CMS, database software, web server, or source code created by Digital Web Future. Only in the case of a custom-built solution under a “work for hire” arrangement would the client own the source code. Clients do own the HTML/CSS/JavaScript, visual design, and authored content after project completion and payment.

Final Note:

If a client requests the website’s source code, Digital Web Future will not share the CMS technology, MySQL databases, sub-domains, or server credentials. The backend and location-specific pages are proprietary to Digital Web Future. Clients can, however, obtain domain control panel access (if purchased by us) after clearing all dues. HTML/CSS/JavaScript, design, and content are provided after final payment.

Web Hosting Details:

To safeguard our proprietary tech and server security, hosting credentials will not be shared. Hosting is a complimentary service with our websites. Installation of third-party software like WordPress, Joomla, Magento, etc. is not allowed.

Domain Details:

As long as the client continues service with Digital Web Future, domain credentials purchased by us will not be shared. Upon written request, we will transfer domain control panel access to the client, provided they accept full responsibility and absolve Digital Web Future of any liabilities post-transfer.

Client Servers:

Digital Web Future does not host websites or web applications developed by us on third-party or client-owned servers.

We provide support exclusively through email.

Control Panel Support:

Support for issues within the control panel is provided with certain limitations, covering basic functions such as account addition or deletion, DNS management, password changes, etc. Limited support is available for third-party software like PHP-Nuke, Advanced Guest Book, phpBB, osCommerce, etc. Digital Web Future does not support free add-on scripts included in the control panel or address software errors or bugs from third-party vendors; such issues should be reported directly to the respective software providers. Web development, third-party scripts, software installation, maintenance, compatibility, and routine administrative tasks like managing email accounts, domains, and user creation are beyond the scope of Digital Web Future’s support. However, Digital Web Future may assist with initial custom server configurations, including setting up email accounts, domains, new users, and software adjustments (e.g., SSL certificates, clientexec), at its discretion and without additional charges.

Third-Party Software Installation:

Users are fully responsible for installing third-party software in their web space. If any hacking or unusual activities occur due to insecure software, it may result in account termination without prior notice.

Specifications and Limitations of Responsibilities:

Digital Web Future is not liable for any damages, including incidental or consequential damages, arising from server unavailability or downtime. The company is not responsible for any claims, including incidental or consequential compensation, resulting from the compromise or removal of any website from its servers. Immediate service termination is the maximum limitation in such cases.

Stipulations & Disclaimers:

Digital Web Future is not responsible for data loss, crashes, or system failures/downtime. The company is also not accountable for any projected profits clients may anticipate from their website’s operation. As a reseller of certain services, some tools, routing, software, or programming used are not directly owned or developed by Digital Web Future. The company holds no responsibility for the usage of clients’ accounts. Failure to adhere to any terms or conditions may lead to account deactivation without discussion. Decisions to delete or deactivate accounts are based solely on terms set by Digital Web Future and can be executed without notice. The company reserves the right to change or modify these policies, guidelines, and disclaimers at any time without prior notification.

Copyright Policy:

Digital Web Future holds exclusive rights to protect all information, materials, services, and content under copyright and other intellectual property laws. Unauthorized reproduction of any information, materials, services, or content is subject to legal action under copyright law.

Guidelines for Use of Site Information and Materials:

Viewing, downloading, printing, or distributing materials and information from Digital Web Future is subject to the following conditions:

Information should be used strictly for non-commercial, personal, or informational purposes.

Payment and Refund Policy:

All payments must be made using standard modes set by Digital Web Future. As we maintain high interaction with our clients and carry out processes with their approval, there is no provision for full or partial refunds. Once an order is placed, it cannot be canceled as it is processed immediately. Changes in personal preferences over time do not qualify for refunds or chargebacks. The company will not provide content through any other media such as CDs, pen drives, or movable drives to avoid complications and technical issues. Upon provision of this information, you are solely responsible for the login information and content of the sites provided. All payments for services must be made in favor of “Digital Web Future” only. We have not authorized any individual or organization to collect payments in any other name for services rendered by Digital Web Future. Under no circumstances will Digital Web Future be liable for any damage caused in your business transactions with such fraudulent individuals or organizations.

Dispute Resolution and Jurisdiction:

Any legal disputes related to Digital Web Future will be addressed exclusively in the territory of Delhi. All legal matters are subject to the prevailing laws in force in New Delhi and under the jurisdiction of courts located in New Delhi only.

Governing Law and Jurisdiction:

This Agreement and any disputes arising from the use of Digital Web Future are governed by the laws of India. Both the Member and the Company submit to the exclusive jurisdiction of the courts in Delhi, India. This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of Digital Web Future, constitutes the entire agreement between you and Digital Web Future regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remaining provisions shall continue in full force and effect.
